Spam / Unsolicited Commercial Email - By our definition, any email which was not specifically requested by the recipient either explicitly or implicitly is considered to be spam. This includes such things as advertisements for goods and services, whether or not the goods and services are useful to the recipient. It does not include such things as email from your uncle Harry unless Harry is sending you advertisements that you specifically requested he not. Spam will not be tolerated either incoming or outgoing. Clients of Cyber Gestalt Internet Services may not send out spam. If clients receive spam, they should notify us of the offending email as soon as possible. For each spam email, California law provides for a $50 civil penalty under California Business and Professions Code Section 17538.45.

The sending of any unsolicited email advertising messages to or from this domain or any virtual domains hosted by Cyber Gestalt Internet Services, will result in the imposition of civil liability against you in accordance with Cal. Bus. & Prof. Code Section 17538.45.

Bottom line is just don't do it.

Network / System Abuse - Clients or visitors to Cyber Gestalt or any of the domains hosted by us, may not do anything which would constitute network or system abuse. The servers, switches and other equipment used to provide web services are private property. Accessing these servers without having proper authorization to do so is considered abuse and trespassing. Sending information to or through the network without proper authorization is also considered abuse and trespassing.

Clients may only access their accounts on the various servers as specifically provided to them. Guests may only access information through normal means. This currently includes normal browser access to client sites and sending non-spam email to client email address. Anything else constitutes abuse. All abuse is investigated and prosecuted. There are hackers in jail currently as a result of our efforts. While punishment is not usually this severe, we always seek the maximum penalty. All illegal or abusive activities are reported to law enforcement.

Illegal Activities - Just like Network or System Abuse, any and all forms of illegal activity are prohibited by clients and guests and will be prosecuted.

Network Abuse of the Internet - Just like abuse of Cyber Gestalt systems and network is prohibited, so too is abuse of the Internet systems and networks. This includes violating ISP Terms of Service, spamming, hacking, trespassing, harassment, Improper Usenet access or posting and so on. Again, just don't do it.

Backup and Disaster Recovery - Cyber Gestalt Internet Services specifically does not back up client data. Clients are required to maintain their own backups on their local machines of all files and software uploaded to the servers. In the event of accidental or deliberate deletion or corruption of data, the client is responsible for reloading the data to the server. In the event of catastrophic failure, such as a disk crash, earthquake, fire, etc, Cyber Gestalt will restore the network and servers as quickly as possible and the client is responsible for restoring their site from local backups.

Content - Space on the servers of Cyber Gestalt Internet Services is provided to facilitate your business. We realize that many businesses cannot afford a huge web presence so we provide quality hosting at low rates. Since hosting of this type is expensive, we restrict the types of content allowed on client sites.

These restrictions are to conserve resources as well as for legal reasons. No pornography, warez or mp3 sites are allowed. Content must be related to your business. Hate material, inflammatory material, propaganda, political material or fraudulent material is also prohibited. In addition, no software intended to cause damage to the Internet, other networks, computers or other machines or that is intended to fraudulently gain access to other people's machines or networks may be posted. This includes, but is not limited to virii, trojan horses, email bombs, worms, corrupted data or any harmful components such as javascript, vbscript, java applets or ocx Active controls.

No sub sites are allowed. That is, if a bakery has a site with us, the owner cannot put up a personal page for a friend under his domain. Our hosting services are intended for active web sites. This includes html, images, other content and support scripts. It does not include using the servers as your personal digital storage medium. It is unwise as we do not guarantee the stability of your data. In the event of loss of data, the user is fully responsible for recovery of that data. You should keep backup of all your online data, not the other way around.

Scripts - We take security very seriously. The top sources of security breaches are password compromise, and CGI scripts. You should safeguard your password to the system. If you ever suspect that your password has been compromised, you MUST contact us immediately so we can disable / change the password plus take other steps to prevent any intrusion by others.

CGI scripts are a particularly sensitive area. It is recommended that you contact us regarding any needs for scripts. We probably already have something that does what you need. Scripts MUST be Perl only. No shell scripts or other types of scripts are allowed. They will be deleted without notice. You are strongly discouraged from uploading scripts found on other sites, especially without checking them first. We reserve the right to review and delete any scripts found to have any security breach, without notice.

Linking - You may link to other sites as you see fit except for material which is deemed inappropriate. Linking to illegal material is discouraged as is any links to material which would result in others targeting you or any of Cyber Gestalt Internet Services' equipment or network for attack.

Other sites may link to your site per the following restrictions. An external site may link to a page or pages within your site. This includes direct html linking as well as links into the shopping cart for clients using it. External sites MAY NOT link to individual elements within your site. That is, external sites may not link to graphic files, scripts, software, java applets, and so forth. If the link does not produce a page from within your site, it is not allowed. If an external site wishes to display graphics or provide scripts / applets / etc. from your site, that element should be downloaded once and stored on the external site, with your permission, of course.

Use of resources - You account is provided to facilitate your business. Network, machine and bandwidth resources are costly. If you site starts using an excessive amount of these resources, we will let you know the situation. You may at your option, 1) redesign your site so its resource usage is less, 2) negotiate to provide additional compensation to Cyber Gestalt Internet Services or 3) move your site to another hosting service. We hope that if your site is doing well, that your business is also doing well. In this case, it should be no problem to pay an increased fee to cover the additional resources being used. We provide top quality services are very reasonable rates and hope that option 3) will not be an attractive option.

Content of other clients - We review all content on our servers regularly. If you find content that you did not upload (such as another client), we probably already know about it. We will investigate any concerns, but ultimately, you should take up your concerns with the owner of the offending site. If we feel the content of the offending site violates any of our terms, we reserve the right to take it down, or delete it without prior notice. It is always best to discuss your content with us if there is any doubt.

Privacy - We do not share information about our clients with anyone. On the other hand, we reserve the right to review any and all data on any of our servers at any time and without notice.

Publishing data - You grant Cyber Gestalt Internet Services the right to send, display or otherwise transmit your data as uploaded, to any third party requesting it via the Internet. Basically uploading your data to our servers shows your intention of having it be seen on the Internet.

Our rights - We reserve the right to review any data on any of our systems without notice. We reserve the right to remove any improper data on any of our systems, without notice.. We reserve the right to update our policies for acceptible use at any time without notice.

A final note - Cyber Gestalt Internet Services values freedom of expression, but does not guarantee freedom of speech. Cyber Gestalt Internet Services is the final arbiter of what is allowed and what is not on any of our servers.
